Rental Agreement
1. Rental Period and Return
Customer rents the listed totes and accessories for the dates shown above and will make them available for pickup or return them by the agreed date. Extensions require approval and payment before the original return date.
2. Payment and Deposit
Rental charges are due before delivery unless Stack & Go Totes agrees otherwise in writing. Any security deposit may be applied to unpaid rent, late fees, cleaning, damage, missing equipment, or replacement costs. The remaining deposit will be returned after inspection.
3. Delivery and Pickup
Customer will provide safe, lawful access at the scheduled location and a responsible adult must be available unless written no-contact instructions are accepted. Redelivery, missed pickup, stairs, gates, parking restrictions, or service outside the quoted area may result in added charges disclosed before service when practical.
4. Care and Permitted Use
Totes must be kept dry, secure, and reasonably clean. Do not use them for hazardous, illegal, flammable, corrosive, biohazardous, excessively heavy, or food-waste materials. Do not alter, paint, drill, sell, sublease, or remove business labels.
5. Loss, Damage, and Cleaning
Customer is responsible for totes and accessories from delivery until accepted back. Customer authorizes reasonable charges for missing, destroyed, unusually dirty, or damaged items beyond ordinary wear. Replacement charge per tote: $________. Excess cleaning charge: $________.
6. Late Return and Unavailable Equipment
Approved extra weeks are charged at the package extension rate. If items are not available as agreed, customer may be charged $ 50 per tote per week plus reasonable recovery costs, subject to applicable law.
7. Cancellation and Refunds
Cancellation more than 24 hours before delivery: refund less any stated processing fee of $50. Cancellation within 24 hours or failed delivery caused by customer: up to $50 may be retained. Stack & Go Totes will refund charges for any service it cannot provide.
8. Risk and Liability
Customer is responsible for packing, loading, transport, and the contents placed in totes. Stack & Go Totes is not a mover or insurer and is not responsible for loss or damage to contents except to the extent caused by its proven negligence or as otherwise required by law. Nothing in this agreement waives rights that cannot legally be waived.
9. Entire Agreement and Disputes
This agreement, the order summary, and written addenda are the complete agreement. Changes must be in writing. California law applies, without limiting any mandatory consumer protections. Before filing a claim, each party agrees to make a good-faith effort to resolve the issue directly.
Customer Authorization
By signing, customer confirms the rental details are accurate, has read and accepts these terms, authorizes the stated charges, and acknowledges receipt of the Privacy Policy.
